Class Actions over Volkswagen emissions and Air Canada flight passes have both been in the news lately. Issues including how class action are started, how you find out about them, and who’s included are discussed. In most cases, once a class action is certified, potential class members would be notified and they would then be included unless they take steps to opt out. Where there are multiple representative plaintiffs and law firms interested in taking on a class action a judge would be required to determine which class action would be certified.
