Real estate agent suspended and Supreme Court of Canada duty of good faith

85Victoria lawyer Michael Mulligan on CFAX Legally Speaking with Pamela McCall – discussing the five year suspension of a Victoria real estate agent by the Real Estate Council of British Columbia for professional misconduct. The agent was found to have breached his duties to the client by having her purchase a leaky condominium, listed by his son, while his client was a patient in a psychiatric hospital. Legal issues discussed include the special duty owed by real estate agents to their clients are along with a recent Supreme Court of Canada decision that imposes a duty of good faith performance of contracts more generally.
