Michael Mulligan on CFAX – Entrapment and the Legislature Bomb Case

entrapment.jpgCriminal Lawyer Michael Mulligan on CFAX – Legally Speaking with Pamela McCall – discussing the law with respect to entrapment in the context of the Nuttall and Korody legislature bomb case. In Canada, there are two forms of entrapment: 1) When the police provide people with an opportunity to commit a crime without having a reasonable suspicion they were already engaged in criminal activity – sometimes called random virtue testing or 2) When they go beyond providing an opportunity to commit a crime and instead induce the commission of an offence.

In the legislature bomb case, the RCMP spent months conducting an undercover investigation of the accused and ultimately took both accused for a holiday weekend so that they could relax and focus on making a terrorist plan. The undercover police officers became frustrated when the suspects wouldn’t focus on or progress with a specific plan.
